Terms and Conditions
These terms and conditions are valid exclusively between the company GINO GUITARS S.R.L., with registered office at Viale Certosa, 191 – 20151 Milan, VAT no. 09224050964 (hereinafter referred to as "GINO GUITARS") and any person making online purchases on the website www.ginomusica.it (hereinafter referred to as the "CUSTOMER"). These terms may be subject to amendments, and the date of their publication on the website shall constitute the effective date.
These terms govern purchases made on the website www.ginomusica.it, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree no. 206/2005, as amended by Legislative Decree no. 21/2014 and Legislative Decree no. 70/2003 concerning e-commerce.
ARTICLE 1 - Subject matter of the contract
Under these General Terms and Conditions of Sale, Gino Guitars sells and the CUSTOMER purchases at a distance the tangible movable goods listed and offered for sale on the website www.ginomusica.it. The contract is concluded exclusively via the internet, through the CUSTOMER’s access to the website www.ginomusica.it and the completion of a purchase order in accordance with the procedure set forth on the website. The CUSTOMER undertakes to review these General Terms and Conditions of Sale, particularly the pre-contractual information provided by GINO GUITARS, prior to confirming the order, and to accept them by ticking the designated box.
ARTICLE 2 - Pre-contractual information for the consumer - Art. 49 of Legislative Decree 206/2005
Before concluding the purchase contract, the CUSTOMER shall review the characteristics of the goods as described in the individual product sheets at the time of selection.
Prior to the conclusion of the purchase contract and before validating the order with a “payment obligation,” the CUSTOMER is informed regarding:
- The total price of the goods, including taxes, with a detailed breakdown of shipping costs (contribution) and any other charges;
- Payment methods;
- The terms, conditions, and procedures for exercising the right of withdrawal (Article 7 of these terms);
- The information that the CUSTOMER shall bear the cost of returning the goods in case of withdrawal; - The existence of the legal conformity guarantee for the purchased goods;
- The post-sale assistance conditions and commercial warranties provided by GINO GUITARS.
The CUSTOMER may at any time, and in any case before concluding the contract, review the information concerning GINO GUITARS, including its geographical address, telephone and fax numbers, and email address, which are also provided below:

ARTICLE 3 - Conclusion and effectiveness of the contract
The sales contract shall be deemed concluded upon GINO GUITARS sending the CUSTOMER an order confirmation email. The email shall contain the CUSTOMER’s details, the order number, the price of the purchased goods, shipping costs, and the delivery address to which the goods will be sent.
The CUSTOMER undertakes to verify the accuracy of the personal data contained therein and to promptly notify GINO GUITARS of any corrections.
GINO GUITARS undertakes to describe and present the items sold on the website as accurately as possible. Nevertheless, some errors, inaccuracies, or minor discrepancies between the website and the actual product may arise. Furthermore, the photographs of the products displayed on www.ginomusica.it are not contractual elements, being merely illustrative.
GINO GUITARS undertakes to deliver the goods within 30 days from the date of sending the order confirmation email to the CUSTOMER.
Once the sales contract is concluded, the CUSTOMER undertakes to collect the ordered goods. Failing this, all shipping and storage costs shall be charged and must be reimbursed within 10 working days. Otherwise, such costs shall be recovered through legal means.
ARTICLE 4 - Product availability
Product availability refers to the actual availability at the time the CUSTOMER places the order. Such availability must, however, be considered purely indicative, as due to the simultaneous presence of multiple users on the website, products may be sold to other CUSTOMERS before the order is confirmed.
Even after the order confirmation email is sent by GINO GUITARS, partial or total unavailability of goods may occur. In such cases, the order will be automatically adjusted by removing the unavailable product, and the CUSTOMER will be immediately notified via email.
If the CUSTOMER requests the cancellation of the order, thereby terminating the contract, GINO GUITARS shall refund the amount paid within 14 days from the date GINO GUITARS becomes aware of the CUSTOMER’s decision to terminate the contract, unless the goods have already been prepared for shipment: in such case, €40 (VAT included) shall be withheld from the refund as reimbursement for packaging and setup costs.
ARTICLE 5 - Payment methods
All payments by the CUSTOMER may be made exclusively via the credit cards listed on the website www.ginomusica.it, by bank transfer, through Finodmestic financing, or in cash upon delivery (cash on delivery).
In case of payment by credit card, the actual charge will be made upon GINO GUITARS sending the order confirmation email.
ARTICLE 6 – Prices
All product sale prices listed on the website www.ginomusica.it are expressed in Euros and include VAT.
Shipping costs are not included in the purchase price but are indicated and calculated at the conclusion of the purchase process before payment is made.
The CUSTOMER acknowledges GINO GUITARS’ right to modify its prices at any time; however, the goods will be invoiced based on the prices listed on the website at the time of order creation and indicated in the confirmation email sent by GINO GUITARS to the CUSTOMER.
In case of a computer, manual, technical, or any other error resulting in a substantial, unintended alteration of the public sale price, rendering it exorbitant or clearly negligible, the purchase order shall be deemed invalid and canceled, and the amount paid by the CUSTOMER shall be refunded within 14 days from the date of cancellation.
ARTICLE 7 - Right of withdrawal
In accordance with applicable legal provisions, the CUSTOMER has the right to withdraw from the purchase without penalty and without providing any reason, within 14 days from the date of receipt of the products.
The right of withdrawal applies exclusively to consumers (natural persons) acting for purposes unrelated to their professional activity. Therefore, the right of withdrawal may not be exercised by legal entities or natural persons acting for purposes related to a professional activity. Purchases made by retailers or any party purchasing for resale to third parties are also excluded from the right of withdrawal.
The CUSTOMER intending to exercise the right of withdrawal must notify GINO GUITARS via an explicit declaration, which may be submitted through the dedicated section of our website, and must await return authorization. Please note that "customized" products, products specially ordered upon request, and products invoiced to legal entities or natural persons acting for professional purposes are non-refundable.
The right of withdrawal does not apply to audiovisual items or computer software delivered via download or in sealed packaging, to made-to-order items, "customized" orders, or sealed goods that, for reasons of health protection, hygiene, or warranty effectiveness, are unsuitable for return.
In case of exercise of the right of withdrawal, the CUSTOMER must return the goods at their own expense to GINO GUITARS - Via Cavour 7 - 21013 Gallarate (VA), after requesting return authorization via the designated form.
The direct costs of returning the products shall be borne by the CUSTOMER. The returned goods are shipped under the CUSTOMER’s responsibility, including in case of transport damage or theft: it is therefore advised to insure the goods for their full value.
The goods must be returned intact, unaltered from their original condition, in the original packaging, complete in all their parts (including packaging and any accompanying documentation and accessories: manuals, cables, etc.), and with the attached fiscal documentation, without removal of the original protective films. Subject to verification of compliance with the above, GINO GUITARS shall refund the amount of the products subject to withdrawal within a maximum of 14 days from receipt of the goods.
As per Art. 56(3) of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, GINO GUITARS may withhold the refund until receipt of the goods.
GINO GUITARS shall process the refund using the same payment method chosen by the CUSTOMER at the time of purchase, net of outbound and return shipping costs incurred (any "free shipping" promotions do not exempt from the reimbursement of such costs in case of withdrawal). In case of payment by bank transfer, and if the CUSTOMER wishes to exercise the right of withdrawal, they must provide GINO GUITARS with the bank details (IBAN, SWIFT, and BIC codes) required for the refund, via the designated RMA Request Form.
Goods returned damaged, no longer considered new, or showing signs of wear shall be refunded with a reasonable deduction or returned to the CUSTOMER, at GINO GUITARS’ discretion.
ARTICLE 8 - Legal conformity guarantee
In case of receipt of non-conforming or defective products, the CUSTOMER is entitled to restoration of conformity through repair or replacement of the product, at GINO GUITARS’ discretion. The CUSTOMER may exercise this right if the defect manifests within two years from delivery of the goods and notifies GINO GUITARS of the defect.
ARTICLE 9 - Commercial warranty
All products listed on the website www.ginomusica.it benefit, in addition to the legal conformity guarantee under the preceding article, from a commercial warranty, the duration of which is specified in the product sheets.
To avail of warranty assistance, the CUSTOMER must retain the fiscal receipt or commercial invoice related to the purchase.
ARTICLE 10 - Delivery methods
The products shall be delivered via express courier to the address indicated by the CUSTOMER at the time of the order, within and no later than 30 days from the date the CUSTOMER receives the order confirmation email sent by GINO GUITARS, unless otherwise agreed between the parties.
For each order placed on the website www.ginomusica.it, GINO GUITARS issues a commercial invoice or fiscal receipt for the shipped goods.
In case of failed delivery due to the recipient’s absence, any storage and redelivery costs shall be borne by the CUSTOMER.
ARTICLE 11 – Liability
GINO GUITARS shall not be liable for service disruptions attributable to force majeure or unforeseeable circumstances, including those arising from internet malfunctions or service interruptions, if it fails to execute the order within the timeframes stipulated in the contract.
ARTICLE 12 - Website access
The CUSTOMER is entitled to access the website for browsing and making purchases. Any other use, particularly commercial, of the website or its content is prohibited. The integrity of the elements of this website, whether audio or visual, and the related technology used remain the property of GINO GUITARS and are protected by intellectual property rights.
ARTICLE 13 – Cookies
The website www.ginomusica.it uses "cookies." Cookies are electronic files that record information related to the CUSTOMER’s browsing on the website (pages viewed, date and time of access, etc.) and allow GINO GUITARS to offer a personalized service to its customers.
GINO GUITARS informs the CUSTOMER of the option to disable the creation of such files by accessing their internet configuration menu. Please note that this will prevent the CUSTOMER from proceeding with online purchases.
ARTICLE 14 – Entire agreement
These General Terms and Conditions of Sale constitute the entirety of the clauses herein. If one or more provisions of these General Terms and Conditions of Sale are deemed invalid or declared as such under the law, regulations, or by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
ARTICLE 15 - Governing law and Jurisdiction
These General Terms and Conditions of Sale are governed by Italian law.
Any dispute not resolved amicably shall be subject to the exclusive jurisdiction of the Court of the CUSTOMER’s place of residence or domicile, if located within the territory of the State. In any case, the parties may optionally resort to the mediation procedures under Legislative Decree 28/2010 for the resolution of any disputes arising from the interpretation or execution of these terms and conditions of sale.
